1. Definitions

In these General Terms and Conditions, the following terms shall have the meanings set forth below:

1.1 Foundation: Stichting Vrienden op de Fiets, registered with the Chamber of Commerce under number 41052534.

1.2 Friend(s): Any natural person who has registered as a participant of Vrienden op de Fiets and has agreed to these General Terms and Conditions. Friends may use the Guest Addresses.

1.3 Friend Card: A personal, non-transferable card that allows the holder to access the services and benefits associated with being a Friend. This card contains a Friend number, the holder’s name, and the year in which the card is valid. The Friend Card can be viewed digitally via the online profile on the website.

1.4 Guest Address(es): A private individual who offers lodging to Friends.

2. Applicability

2.1 These general terms and conditions apply to all agreements and legal relationships between the Foundation and the Friends.

2.2 By registering as a Friend, you agree to these general terms and conditions.

2.3 These general terms and conditions do not apply to Guest Addresses.

2.4 Deviations from these terms and conditions are valid only if agreed upon in writing.

3. Friendship

3.1 The “Friendship” (“membership”) of Vrienden op de Fiets provides access to the digital platform featuring Guest Addresses on Vriendenopdefiets.nl.

3.2 The annual membership fee for the Friendship is set each year by the Foundation’s board. The Foundation reserves the right to index the membership fee annually and to implement price changes. Friends will be notified of price changes at least one month before the effective date of the new annual membership fee.

3.3 Use of the services provided by Vrienden op de Fiets is personal and non-transferable to others, except as described in the terms of your membership and the Basic Rules. By using the services of the Vrienden op de Fiets Foundation, you agree to pay the annual membership fee as determined by the Foundation.

4. Two Types of “Friendship”

4.1. The Vrienden op de Fiets Foundation recognizes two types of Friendship.

4.2.1 Friends residing in the Netherlands

Friends residing in the Netherlands enter into a rolling Friendship. The Friendship runs from January 1 through December 31 and is automatically renewed unless canceled by December 1 of the current year.

4.2.2 The membership fee is automatically debited annually from the bank account number provided by the Friend. If the direct debit fails, a single attempt will be made to process the payment again. In the event of a permanent failure or reversal of the direct debit, a payment reminder will be sent with a request to pay the amount within 14 days.

4.2.3 The Foundation reserves the right to block digital access to the Guest Addresses if the direct debit fails or is reversed for any reason. Access will be restored as soon as the annual membership fee due has been credited to the Vrienden op de Fiets account. The payment obligation is not suspended by the suspension of access.

4.3 Friends living outside the Netherlands

Friends living outside the Netherlands may sign up for a one-year Friendship membership, which automatically ends at the end of the calendar year.

5. The Price of Friendship

5.1 Friends living in the Netherlands: Ongoing Membership

5.1.1 By confirming the online registration (“Join Now”), the Friend authorizes Stichting Vrienden op de Fiets to collect the annual membership fee via direct debit on an ongoing basis. This authorization expires upon termination of the membership.

5.1.2 The Friendship is entered into for a term of one calendar year and is automatically renewed.

5.2 Friends residing outside the Netherlands: One-Year Friendship

5.2.1 The annual membership fee for Friends outside the Netherlands can be paid using various payment methods, including BanContact, PayPal, or credit card.

5.2.2 The Friendship is entered into for a term of one calendar year and automatically ends at the end of that year.

5.2.3 Vrienden op de Fiets reserves the right to charge different annual membership fees depending on the country. The current annual membership fee can be found on the website.

6. Friend Card

6.1 When you become a Friend, you will receive a personal, non-transferable Friend Card. This pass includes your Friend number, your name, and the year for which it is valid. You will receive a new Friends Card every January. Friends can also use the digital Friends Card, which is available after logging in.

6.2 Online Friendship is valid immediately upon enrollment, as is the digital Friends Card.

6.3 The Friends Card must be presented when staying overnight at a Guest Address provided by the Vrienden op de Fiets Foundation. Presentation of a valid Friend Card is required to access the services and benefits associated with Friendship.

7. Communication and Documentation

7.1 All communication between the Foundation and its Friends takes place primarily via email. This includes, but is not limited to, notifications, announcements, invoices, and other correspondence.

7.2 It is the Friend’s responsibility to provide the Foundation with a valid and up-to-date email address and to ensure that emails from the Foundation are not filtered into spam or junk folders.

7.3 Online access to Guest Addresses on Vriendenopdefiets.nl may be supplemented with a physical Address Guide and/or Route map containing the most up-to-date overview possible of the affiliated Guest Addresses. These may be ordered and paid for separately by the Friend via a digital ordering method. The exact costs will be communicated to the Friend at the time of the request. No refunds are available for the costs of the supplementary products after the order has been placed and payment has been made, unless otherwise stated by the Vrienden op de Fiets Foundation at the time the order is placed.

7.4 The Vrienden op de Fiets Foundation is not liable for any delays, loss, or damage that may occur during the shipping process of the supplementary products.

8. Obligations of the Friends

8.1 Friends must adhere to the basics of your Friendship and the Basic Rules as stated on the website of the Vrienden op de Fiets Foundation.

8.2 It is the responsibility of Friends to keep their personal information up to date. The Vrienden op de Fiets Foundation is not liable for information entered incorrectly by the Friend.

8.3 Friends must treat the hospitality and accommodations provided by Guest Addresses with respect and report any damage immediately to the Guest Address.

8.4 Friends are not permitted to engage in commercial activities within the framework of the Foundation, nor to use the personal information and/or addresses of Friends and Guest Addresses for purposes other than those related to the Foundation.

9. Liability

9.1 The Foundation is not liable for any damage occurring during a stay at an accommodation. The Vrienden op de Fiets Foundation accepts no responsibility or liability for the quality of Guest Addresses, the conduct of Friends affiliated with the Foundation, or damage caused by Friends at Guest Addresses; nor for damage suffered or caused by Friends while traveling or elsewhere; nor for incomplete or incorrect information in the Address Guide or on the website.

9.2 Friends are personally responsible for obtaining adequate insurance against damage and accidents during their stay; in any event, Friends are obligated to compensate for any damage caused.

9.3 None of the (digital) publications of Vrienden op de Fiets may be copied, reproduced, or otherwise used for any purpose other than that for which they are intended without the explicit permission of the Vrienden op de Fiets Foundation.

10. Privacy

10.1 The Foundation processes Friends’ personal data in accordance with applicable privacy laws. Please see the privacy statement on the website.

10.2 Friends have the right to access, correct, and delete their personal data as described in the privacy statement on the website.

11. Cancellation / Termination of the Friendship

11.1 Friends may cancel their Friendship by December 1 of the current year. For Friends outside the Netherlands, the Friendship ends automatically.

11.2 Cancellation can be done via the online profile on the website or by sending an email to administratie@vriendenopdefiets.nl. The Friend will receive a confirmation of this via email.

11.3 Other methods of cancellation will not be accepted; the Friend’s rights and obligations remain in effect.

12. Right of Withdrawal

12.1 Immediately after registration, the Friend gains access to the online platform containing Guest Addresses and related information. This marks the immediate start of service provision. Once the Friend has gained access to this online information, the membership is deemed to have been activated. Because the content of this service (such as addresses and contact information) can be permanently recorded, it cannot be “returned.” For this reason, no refund of the annual membership fee or additional products is possible after access has been granted.

13. Amendments and Termination

13.1 The Foundation reserves the right to amend these Terms and Conditions. Amendments will be communicated to Friends in writing or by email. We will not provide separate notice for minor or editorial changes that do not affect the rights and obligations of the Friend.

13.2 If a Friend does not agree with the amendment to the General Terms and Conditions, the Friend has the right to terminate the Friendship within four weeks of notification of the amendment.

13.3 The Foundation may terminate a Friend’s membership in the event of a violation of these Terms and Conditions, if the annual membership fee is not paid (on time), if a Friend acts in violation of the basis of your membership and the Basic Rules, or in the event of conduct that is harmful to the Foundation or its Friends and/or Guest Addresses.

14. Final Provisions and Disputes

14.1 These Terms and Conditions are governed by Dutch law.

14.2 Any disputes arising out of or in connection with these Terms and Conditions shall be submitted to the competent court in The Hague.
